Terms of Service

These Terms of Service ("Terms") govern access to and use of Pharma Transport (the "Service"), provided by Thomas Information Technology ("Thomas IT," "we," "us," or "our"), a company based in Phoenix, Arizona. By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organization you represent.

1. The Service

Pharma Transport is a logistics and chain-of-custody platform for pharmaceutical transport: fleet GPS tracking, custody event logging, and generated compliance documentation (including Compliance Packets and chain-of-custody records).

2. Accounts and organizations

Creating an account also creates an organization, and the creator becomes its administrator. You're responsible for the accuracy of information you or your organization's users submit, for keeping login credentials confidential, and for all activity under your account. You must be legally authorized to act on behalf of any organization you register.

3. Subscriptions and billing

New organizations start on a free plan, which includes a limited number of generated Compliance Packets per calendar month. A paid subscription removes that monthly limit. Paid subscriptions are billed in advance on a recurring basis through Stripe, our payment processor, and continue automatically until canceled. An organization administrator can cancel at any time from the Billing page; access to paid features continues through the end of the then-current billing period. We don't store your payment card details ourselves -- Stripe handles and stores that information directly.

4. Your data

You retain ownership of the data you and your organization submit to the Service (batch records, custody events, vehicle and GPS data, uploaded signatures and documents). You're responsible for the accuracy of that data. We may remove or suspend access to data that violates these Terms or applicable law.

5. Compliance disclaimer

The Service is a tool to help you record, organize, and document custody and transport data, and to generate reports from that data. Using the Service does not, by itself, guarantee compliance with 21 CFR Part 11, other FDA regulations, or any other legal or regulatory requirement. You remain solely responsible for your organization's regulatory compliance program, for the accuracy of data entered into the Service, and for determining whether the Service meets your specific compliance obligations.

6. Acceptable use

You agree not to misuse the Service -- including attempting to access another organization's data without authorization, submitting knowingly false custody or compliance records, or interfering with the Service's normal operation.

7. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, Thomas Information Technology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access to the Service for a violation of these Terms, or for nonpayment of a subscription fee.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.
